Punjab is in uproar as the news spread that the entire state will be forced to wear pink. The RSS has issued a statement arguing that all shirts should be saffron and the color variants are an “attempt to divide and conquer”, whilst many tribals want to know what exactly a t-shirt is.

But the scheme has proved popular with law enforcement authorities. “This will halve our work load,” said P.L Dutta, a police sergeant in Rohini, “finding criminals is difficult. We have to leave the police station, talk to people, write things down and remember things. With numbers all we have to do is write down the culprit’s number and drive around until we find him; or someone a few digits higher or lower who may know where he is.”

However, security experts claim that identity theft will become reach epidemic proportions. “People will employ guards for their washing lines,” said Nitish Patel, a security consultant, “I foresee a black market of stolen t-shirts and fake identities; we’ll see armed robberies carried out by people with “Mickey Mouse” or “Suresh Kalmadi” written on their shirts. All this will make police work more difficult,” explained Patel.

A day ahead of the Babri Masjid-Ramjanmabhoomi verdict that will put to test India’s ideal of religious tolerance, India was on alert Wednesday with Prime Minister Manmohan Singh and Congress president Sonia Gandhi, among others, appealing for peace and mutual respect.

While the central and state governments stepped up security to ward off any communal trouble following the verdict on the 61-year-old dispute, some said India had moved on since 1992 when the Babri Masjid was demolished by Hindu radicals who believed it was built on the birthplace of Lord Ram.

The demolition of the 16th century mosque in Uttar Pradesh’ town of Ayodhya triggered widespread riots in which at least 2,000 people were killed.

In a passionate appeal, put out as a half-page newspaper advertisement, the prime minister urged people to treat the verdict by the Lucknow bench of the Allahabad High Court on the land dispute with “utmost respect”.

“We must remember the fact that the judgment, at this stage, is one step in the judicial process. The determination of the issues need not necessarily end with this judgment, unless it is accepted by all parties,” the prime minister said amid apprehensions that the ruling could reopen the volatile communal issue.

The three-judge bench will deliver the verdict at 3.30 p.m. Thursday. But the ruling can be challenged in the Supreme Court if any of the parties is not satisfied with the court decision.

Appealing to all sections of people to maintain “equanimity and tranquility”, Manmohan Singh said if any of the parties to the dispute feels that further judicial consideration is required, “there are legal remedies available, which could be resorted to”. Congress president and chairperson of the ruling United Progressive Alliance (UPA) Sonia Gandhi asked people to “respect the verdict of the independent judiciary of India”.

“I respectfully request you to have faith in the judicial system and maintain brotherhood at any cost,” Gandhi said in her appeal written in Hindi.

Added Home Minister P. Chidambaram: “India has moved on, especially the people who were born after 1992 have a different world view.”

“I hope peace and communal harmony will be maintained,” he said, disclosing that more 1.90 lakh “policemen from all formations” would be deployed in Uttar Pradesh.

A senior official added that Uttar Pradesh would be the focus of security action, particularly Ayodhya, the location of the dispute, and Lucknow, where the verdict would be delivered.

Maharashtra, Gujarat, Madhya Pradesh, Jammu and Kashmir, Karnataka and Kerala are some of the states where the judgment could “evoke sharp reaction”, the central government believes.

At a time when the Indian capital is set to host its biggest international sporting event, the Commonwealth Games, beginning Sunday, the home ministry has asked states to strictly enforce security measures in sensitive locations. Administrations have been asked to activate peace committees of Hindus and Muslims.

A special alert has been sounded for cities like Mumbai, Ahmedabad, Bhiwandi, Bhopal, Bangalore, Coimbatore and Hyderabad that have a history of communal flare-ups. Leaders are also sounding caution and appealing for calm irrespective of which side the scales tilt.

The Darul Uloom Deoband, a leading Muslim seminary, has said any reaction to the judgment should be legal.

“The issue has lingered for the last 60 years… it is time the matter is sorted out. We pray peace and harmony is maintained. If any party feels dissatisfied we can always approach the Supreme Court,” Maulana Abdul Khaliq Madrasi, a teacher of the seminary, told IANS.

The Vishwa Hindu Parishad (VHP) too said peace and order should prevail irrespective of the ruling.“The temple will be constructed whatever the court decision would be. But we believe in democratic institutions and would appeal to all our activists and volunteers to maintain peace and order after the verdict,” VHP leader Vinod Bansal told IANS.

“We have made peace appeals in the past as well and do so today also… Peace and communal harmony should not be disturbed. We hope that the verdict will be a positive turning point for the Hindu-Muslim unity in India. Indians have matured and have prepared their mind to accept and respect the court verdict,” Mukhtar Abbas Naqvi of the BJP told IANS.

History of Ayodhya Verdict:

The decades long Ayodhya dispute revolves around the claim over the land in Ayodhya, which is considered scared by Hindus as it is believed to be the birthplace of Lord Ram while Muslims seek to defend the Babri Masjid at the site.

Hindus believe that Ayodhya is the birthplace of Lord Ram, one of the avatars of Lord Vishnu. The land is, therefore, considered sacred and befitting the profile of a holy pilgrimage spot.

The communal tension over the land took root in the construction of the Babri Masji, by Muslim emperor Babur, who in 1527 defeated the Hindu King of Chittorgarh, Rana Sangram Singh at Fatehpur Sikri.

The king left his general, Mir Banki as the Viceroy of the region. Mir Banki, who enforced Mughal rule over the population, came to Ayodhya in 1528 and built the Mosque.

There are claims that when the Mosque built, the Ram temple at Ayodhya was either demolished or modified largely.

Over the years, Hindus have sought to reclaim the ‘Ram Janmabhoomi’ while Muslims have sought to defend the Babri Masjid.

Growth of dispute over the years

According to literature dating back to 1987, before the 1940s the mosque was called Masjid-i Janmasthan (‘mosque on birthplace’) by Indian Muslims

1947 – A Government order prohibited Muslims from being around the site (at least 200 yards). The main gate was locked. However, Hindu pilgrims allowed to enter through a side door.

1984 – The Vishwa Hindu Parishad (VHP) started a campaign to reclaim the site for Hindus so that a temple dedicated to the infant Ram (Ramlala) could be erected.

1989 – Allahabad High Court passed an order that the main gates should be opened up and restored the site to Hindus for eternity.

But the communal discord re-erupted when the Hindus intented to make modifications of the Islamic style structure built by General Mir Banki.

When they inaugurated the proposed new grand Temple with Government permissions, unrest erupted across India as the Muslim community was against this.

This is when Government moved the court, turning the dispute sub-judice

1992 – The dispute took a rather ugly turn on Dec 6, 1992 when the Babri Masjid was demolished during a political rally. This led to riots in which over 2000 were killed.

Ten days after the Babri Masjid demolition, the Liberhan commission was set up to probe the circumstances that led to the demolition.

2003 – On the order of the High Court, the the Archaeological Survey of India carried out excavation at the disputed site of Rama Janmabhumi – Babri Masjid from 12 Mar, 2003 to 7 Aug, 2003. The study reportedly found evidences of an ancient temple.

A 574-page report with maps, drawings as well as opinions was presented before the Lucknow bench of the Allahabad high court in Aug 2003.

Based on the archaeological evidence the the ASI report noted that the remains had distinctive features found associated with the temples of north India and said that there was sufficient proof of existence of a massive and monumental structure having a minimum dimension of 50×30 metres in north-south and east-west directions respectively just below the disputed structure.

2005 – On July 5, 2005, five terrorists attacked the site of the makeshift Ramlalla temple, in Ayodhya.

All the five terrorists were killed in the ensuing gunfight with the Central Reserve Police Force (CRPF), guarding the area. The attack claimed life of one civilian, who died in a grenade blast that the terrorists triggered to breach a cordon wall.

2009 – In Nov 2009, some of the findings of the Liberhan commission was leaked to the media. These leaked reports indicted Bharatiya Janata Party (BJP) leaders like LK Advani and Murli Manohar Joshi.

2010 – On Sep 24, 2010, the Allahabad High Court was slated to give its verdict on the Ayodhya title suit on ownership of the disputed land. On the eve of the judgement, the Supreme Court deferred the verdict by a week on a deferment plea and scheduled hearing of the postponement petition on Tuesday, Sep 28.

Some important observations/ chronicles prior to Indian independence:

As early as 1767, Joseph Tieffenthaler, a Jesuit priest, recorded in his French works that were Hindus worshipping and celebrating Ramanavami at the site of the mosque. In 1788, he recorded that Emperor Aurangzeb demolished the fortress called Ramkot to establish a Mahometan temple.

Even till 19th century, there have been chronicles of Hindus worshipping Ram at the Ramkot hill.

P Carnegy wrote in ‘A Historical Sketch of Tehsil Fyzabad’, 1870, “It is said that up to that time (referring to the the Hindu-Muslim clashes in the 1850), the Hindus and Mohamedans alike used to worship in the mosque-temple.

“Since the British rule a railing has been put up to prevent dispute, within which, in the mosque the Mohamedans pray, while outside the fence the Hindus have raised a platform on which they make their offerings.”

While passing an order over the issue in March 1886, the Faizabad District Judge, Col F E A Chamier, observed:

“I visited the land in dispute yesterday in the presence of all parties. I found that the Masjid built by Emperor Babar stands on the border of Ayodhya, that is to say, to the west and south it is clear of habitations. It is most unfortunate that a Masjid should have been built on land specially held sacred by the Hindus, but as that event occurred 356 years ago, it is too late now to agree with the grievances.”

The Lucknow Bench of the Allahabad High Court will pronounce its verdict on four title suits on the ownership of the Babri Masjid-Ramjanmabhoomi site at 3.30 pm on Thursday.

Sterlite Industries | Shut Down Sterlite Plant Says High Court:

Madras high court on Tuesday ordered the immediate closure of Sterlite Industries copper smelting plant in Thoothukudi.

Allowing the petitions filed by the national trust for clean environment and MDMK general secretary Vaiko in 1996, a division bench, comprising Justice Elipe Dharma Rao and Justice N. Paul Vasanthakumar, said the employees of Sterlite Industries were entitled to compensation from the company.

Expressing concern over Mother Nature being “tarred”, the bench said, “With the ongoing activities of the company, not only the area gets polluted, but would have direct impact on the safety, security and the health of the workers. No doubt, with the order of revoking the licence, the workforce in the company would lose their livelihood.

But, we are constrained to take this decision, owing to the voluminous materials available on record about the negative impact of the running of the industry at the place and in the manner it is being run,” the bench added. The bench said that non-application of mind on the part of the authorities was clear in this case.

Sterlite reacted with caution to the crippling verdict from the court. While stating that it would take “necessary recourse measures” after examining the court order, the company in a release said the plant had been operating for over 12 years and was in compliance with the necessary rules and regulations.

The company called the publication of the earnings “a new beginning” for the troubled company.
Now rebranded Mahindra Satyam after a takeover by the mid-sized software outsourcer Tech Mahindra, the company will report figures for the financial years 2009 and 2010.
The company is also in the process of restating its accounts for the last half dozen years to give a precise picture of the firm’s past performance.
The Hyderabad-based firm’s stock has become more of a speculative share since former chairman B. Ramalinga Raju admitted overstating profits for years and inflating the company’s balance sheet by more than one billion dollars.
But the company’s shares have jumped 14.3 percent over the past month ahead of the earnings release, closing at 98.8 rupees on Tuesday, buoyed by optimism over the earnings.
Raju’s revelations marked India’s biggest corporate fraud and have been likened to the US energy giant Enron, which collapsed in 2001, also over false accounting.
In April, Tech Mahindra, a unit of the tractors-to-holidays conglomerate Mahindra and Mahindra, paid nearly 600 million dollars for a majority share of struggling Satyam.
Investors have been waiting for signs of recovery, particularly after the firm said last week it would delist from the New York stock exchange over fears it may not meet US reporting deadlines for its restated accounts.
Citigroup expects Satyam to post net profit of 6.18 billion rupees (137 million dollars), on revenue of 52.14 billion rupees for the 2010 fiscal year ended March 31.
Satyam has struggled to retain staff in the face of stiff competition from rivals such as Tata Consultancy Services and Infosys Technologies, which have both ramped up recruitment as demand for outsourcing increases.
Sanjeev Hota, senior analyst with Sharekhan stock brokers, said Satyam may face pricing challenges in coming months and could need to lower rates to retain clients.
Satyam’s ability to pitch for deals with potential clients could have been affected in the absence of verified financial accounts, analysts say.
“With predatory competition, client and staff attrition, and a damaged reputation, the combined entity faces an uphill struggle over the next few quarters, if not years,” CLSA analysts said in a recent report.
Raju, who faces a slew of charges including conspiracy, cheating and forgery over the scam, was granted bail on health grounds by a court in the southern city of Hyderabad earlier this month.
Satyam, ranked as India’s fourth-largest outsourcer by revenue when the scandal broke, acts as a back office for some of the world’s biggest companies including Nestle, General Electric and General Motors.
The firm operates in nearly 70 countries, with 690 clients including 185 Fortune 500 blue-chip companies and provided key logistics for this year’s World Cup football tournament in South Africa.
Its logo was on pitch-side advertising hoardings at every match, which managers saw as a way to restore the company’s brand image.

The Supreme Court will announce its verdict on a petition seeking deferment of the Allahabad High Court verdict on the Ram Janambhoomi-Babri Masjid title suit dispute at 2 PM on Tuesday. A three-judge special bench comprising of Chief Justice of India SH Kapadia, Justice Aftab Alam and Justice KS Radhakrishnan has completed hearing the arguments by different parties on the petition moved by Ramesh Chandra Tripathi to postpone the verdict in the case so that efforts could made to reach an out-of-court settlement.

Senior advocate Mukul Rohatgi started the argument on behalf of Tripathi while former attorney general Soli Sorabjee appeared for Sunni Wakf Board. For the first the time the Centre made its stand clear and told the apex court that the uncertainty surrounding the verdict must end.

The Supreme Court had on September 23 issued an interim stay order on the title suit case verdict that was to be pronounced by the Lucknow bench of Allahabad High Court and posted the matter for further hearing on September 28. The two-judge Supreme Court bench comprising of Justice RV Raveendran and Justice HL Gokhale stayed the verdict in “public interest”.

The Supreme Court on Thursday stayed for a week the Ayodhya title suit verdict that was due to be pronounced by Allahabad High Court on Friday and will hear the plea for deferment of the judgement next Tuesday.

The Court issued notices to the contesting parties on the petition filed by retired bureaucrat Ramesh Chand Tripathi challenging the order of the Lucknow Bench of Allahabad High Court order refusing to defer the verdict in the 60-year-old Ram Janambhoomi-Babri Masjid title suit dispute.
It posted the matter for further hearing on September 28.

A Bench comprising Justices R V Raveendran and H L Gokhale stayed the verdict for a week following conflicting views over the issue of entertaining the petition challenging the High Court order.

Justice Raveendran was of the view that the special leave petition filed by Tripathi should be dismissed while Justice Gokhale, on the other hand, was of the opinion that a notice should be issued for exploring the option of settlement.
However, Justice Raveendran, who was heading the Bench, preferred to go by the opinion of Justice Gokhale.
In the order, Justice Raveendran said, “When one of the Judges has a difference of opinion then the tradition is to issue notice.”
Notice was also sent to the Attorney General by the Supreme Court.
A bench of the apex court comprising Justices Altmas Kabir and A K Patnaik had on Wednesday declined to hear urgently the plea to postpone the Ayodhya title suit verdict.
While refusing to hear the petition filed by retired bureaucrat Tripathi, the bench had said that it did not have the “determination” to take up the issue and added that it will be listed before another Bench.
Mukul Rohatgi, senior counsel appearing for Tripathi, said the Supreme Court may give a healing touch by attempting a last-ditch effort at mediation.
He said it was possible that in the face of Supreme Court notices the rival parties may sit across to find an amicable solution.
Rohatgi said that next Tuesday his side would try to tell the court that the matter of judgement should be deferred so that religious, political and national leaders could try and work out a solution.
He also said it was not a matter of just 10 or 20 parties in the case but related to lakhs and crores of people and the mediation could result in some way out.
Tripathi had on Wednesday moved the apex court five days after the High Court’s Lucknow bench rejected his petition for deferring the verdict and to allow mediation to find a solution to the contentious dispute.
The Allahabad High Court had also imposed “exemplary costs” of Rs 50,000, terming Tripathi’s effort for an out-of-court settlement of the dispute as a “mischievous attempt“.
The petition filed by Tripathi sought some time to allow mediation among the parties and also challenged the costs.
Tripathi, in his plea before the apex court, claimed that the verdict might disturb communal harmony and lead to violence in the country.
In the petition filed through advocate Sunil Jain, he cited several reasons for deferment of the verdict, which he said would be in “public interest” in view of the apprehension of communal flare up, upcoming Commonwealth Games, elections in Bihar and violence in Kashmir Valley and Naxal-hit states.
The petition had feared that there would be inadequate security personnel in Uttar Pradesh to provide security.
Tripathi had also referred to an earlier order of the Court on July 27 last that parties concerned are at liberty to approach the Officer on Special Duty for formation of the bench if there was any possibility of disposal of the dispute or arrival at an understanding through consensus.
One of the three judges in the Lucknow bench, however, disagreed with the majority order of September 17 rejecting the plea for deferring the Ayodhya verdict to allow mediation and gave a dissenting opinion that an amicable settlement could have been explored in the protracted legal wrangle.
Justice Dharam Veer Sharma, while not concurring with the view of the other two judges – Justice S U Khan and Justice Sudhir Agarwal – also said in his dissenting judgement that he wasn’t consulted when the three-judge bench gave the order while dismissing the plea for mediation.

IDFC infrastructure bond | IDFC Launches First Long-Term Tax-Free Infra Bonds:

After getting the finance company status from the Reserve Bank of India, the Infrastructure Development Finance Company Ltd., or IDFC, on Monday launched the country’s first long-term tax-free infrastructure bonds having a face value of Rs.5,000 each in one or more tranches to raise Rs.3,400 crore, say reports.

Managing Director and Chief Executive Rajiv Lall said these long-term bonds would hit the market on September 30 (Thursday) and could be subscribed up to October 18. The bonds would come in four series carrying a maximum of 8 per cent coupon.

These bonds, with the highest rating-LAAA—from Icra, could be bought back or redeemed after the five-year lock-in period or could be traded on the bourses, he said. On the conservative way of fixing the yield, Lall said, “Our yield rate is capped at par with the interest rate on government securities and hence cannot offer a yield rate that is above what the 10-year Gilts offer. Also, our objective is to encourage the average retail investors who are salaried as it is a tax-free bond, to invest in these bonds.”

At the BSE, shares of IDFC are now trading at Rs.200.25, down by 2.60% from the previous close.
